1. These terms and acceptance

These business terms govern access to HOMESTEAD Control and related platform services. They apply to each authorised user and the Company they represent. A person accepting them for a Company confirms that they have authority to bind that Company.

These terms incorporate the Control Privacy Policy and Data Processing Agreement. The Data Processing Agreement prevails for conflicting terms about processing personal data.

3. Licence and authorised users

We grant the Company a limited, revocable, non-exclusive and non-transferable licence to use Control for its internal business purposes during its subscription. Software is licensed, not sold. The Company controls its users and is responsible for their use.

4. Accounts, Companies and Domains

  • Keep legal, billing, contact, Domain and user information accurate.
  • Assign the least access needed and remove access promptly when it is no longer required.
  • Do not share credentials; protect devices and use available security controls.
  • Notify us promptly about suspected unauthorised access or a personal-data breach.

A Company may operate multiple Domains. Payment methods are managed at Company level; modules, entitlements and subscriptions are managed at Domain level.

5. Platform services

Depending on enabled modules, HOMESTEAD may provide websites, property and room records, media and virtual tours, pages and forms, enquiries, applications, viewings, tenants, tenancies, documents, communications, maintenance and jobs, suppliers, billing, reporting, audit tools and HOMESTEAD Scribe.

The Company is responsible for configuring and using features lawfully, checking generated or imported content, and maintaining appropriate independent records.

6. Subscriptions, trials and payment

Monthly Domain modules

Paid modules are billed monthly in pounds sterling through Stripe. Prices are shown before confirmation and exclude VAT, which is added where applicable. Free modules may be recorded as a free monthly subscription without a payment charge.

One Company trial

A Company may receive one 14-day module trial on the first Domain that selects a module. The trial is claimed once and cannot be restarted or moved to another Domain. A second Domain is chargeable immediately. During the trial, the selected modules are mirrored into an upcoming paid subscription and changes update that upcoming selection. Charges use the module prices applying when the paid subscription begins.

A valid payment method is required before expiry. If billing is unavailable, payment details are missing or payment fails, module access ends rather than continuing free; paid activation may be completed later. Removing every module cancels the upcoming paid subscription but does not restore trial eligibility or extend the original period.

Changes and cancellation

Module additions and removals take effect when confirmed and may produce immediate prorated charges or credits. Removing every module cancels the Domain subscription immediately. Cancellation does not refund charges already due or paid except where required by law or expressly agreed by us.

The Company authorises off-session charges to its selected payment method and must keep a valid method available. Failed or overdue payment may suspend paid features or access.

7. Company data and data protection

The Company controls the personal data it enters, imports, collects or manages for its contacts, enquirers, applicants, tenants, guarantors, suppliers and other individuals. It must have a lawful basis, provide required notices, respect rights, apply suitable retention, use communications lawfully and avoid unnecessary sensitive data.

We process Company personal data under the Data Processing Agreement.

8. HOMESTEAD Scribe and third-party services

Scribe assists authorised users with bounded marketing and operational content. Output may be incomplete or inaccurate and must be reviewed before publication. Scribe must not be used to generate legal terms, make eligibility or letting decisions, or process data that is not necessary for the requested task.

Integrations and external services may have their own terms and may be unavailable or changed independently of HOMESTEAD.

9. Support, maintenance and availability

We provide reasonable support and maintenance but do not guarantee continuous, uninterrupted or error-free availability. We may carry out maintenance and urgent security work at any time. Service targets are targets only unless a separate signed service level agreement says otherwise.

10. Acceptable use

The Company and its users must not:

  • break the law, send unlawful marketing or misuse personal data;
  • upload malicious, infringing, misleading or unauthorised material;
  • bypass security, permissions, module entitlements or usage controls;
  • copy, resell, reverse engineer or build a competing service from HOMESTEAD; or
  • interfere with the platform, other customers or third-party systems.

11. Intellectual property and content

We and our licensors retain all rights in HOMESTEAD. The Company retains rights in its content and grants us the rights needed to host, process, reproduce and deliver it for the Services. The Company warrants that it may provide and publish its content.

12. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security risk, unlawful use, loss of authority, insolvency or legal requirement. Where reasonably possible, we will give notice and an opportunity to remedy a remediable breach.

13. Export, offboarding and retention

On request and subject to technical feasibility, account standing and applicable fees, we may provide Company data in a format selected by us. Access ends on termination. We may delete or retain data under the Data Processing Agreement, backup lifecycle, law, audit, security and dispute requirements. The Company must arrange exports before access ends where practicable.

Account closure does not reset retention clocks. Applicant records follow the six-year later-of-activity-or-outcome schedule; converted applicant and core tenancy records follow the six-year post-tenancy schedule. Explicit marketing consent is reconfirmed after 36 months of inactivity. Legal holds pause disposal. Demo, trial and paid accounts use the same rules.

14. Warranties and disclaimers

HOMESTEAD is provided with reasonable care and skill but does not guarantee business results, occupancy, enquiries, compliance, availability of a property, suitability of a tenant or the accuracy of Company or third-party data. It is not legal, tax, financial, property or immigration advice.

15. Liability

Nothing excludes liability that cannot lawfully be excluded, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, we are not liable for indirect or consequential loss, lost profit, revenue, business, goodwill or anticipated savings.

Our aggregate liability arising in any 12-month period is limited to the fees paid or payable by the Company for HOMESTEAD during the preceding 12 months, or £100 where no fees were paid or payable.

16. Indemnity and confidentiality

The Company will indemnify us against third-party claims and losses caused by its unlawful content, communications, data processing, breach of these terms or misuse of HOMESTEAD. Each party will protect the other's confidential information and use it only for the contract, law or professional advice.

17. Changes and general terms

We may update the Services and these terms for legal, supplier, security, technical or commercial reasons. Material changes may be notified through Control or email. We may transfer the contract; the Company may not transfer it without consent. No partnership or agency is created. Invalid terms are severed and delay is not waiver. English law and the courts of England and Wales apply.
